Another try for Campus Carry

Patriotic Senator Ron Gould plans to introduce legislation on Monday that would remove current restrictions for students who poses CCW permits while they are on Arizona College Campuses. I'd love to see an even broader bill, but based on past results this is likely the best first step. Please contact Senator Gould and let him know that you support his efforts. He is currently facing an onslaught of left wing anti-gun media coverage claiming that the sky would fall and blood would run in the streets if 21 year old adults who already have CCW permits and already carry a gun everywhere else in the State were suddenly no longer prohibited from defending themselves while they happen to be in yet another so-called "Gun Free Zone"

For those who think Gun Free Zones work, just ask the victims of the Virginia Tech Gun Free Zone how well the zone worked for them. The simple truth is that criminals, rapists, and crazy people do not obey gun free zone signs any more than they would obey a smoke free zone or a no parking zone. They simply ignore them. The people victimized by gun free zones time and time again are the defenseless victims trapped within them.

Governor Brewer Vetoes Campus Carry

In her veto letter yesterday afternoon, Governor Brewer claimed that she vetoed SB 1467 because she was concerned that the public right of way specified in the legislation was not properly defined within it. Is it just me, or does it seem fairly simple to you? If it's a sidewalk or a parking lot, and the public has the right to be there, then it is a public right of way area. If it's a place the general public is not allowed to be, it is not a public right of way area.

That is so simple even a 5th grader can understand it, but apparently it was too difficult for our Governor even with her entire staff to help her out. If they failed to help her figure it out, all she had to do was call me, and I would have been happy to give her a hand. I even happen to have a 6th grader here at home who could have helped her in a pinch if I was too busy at the moment.

She also gave a lame excuse about K-12 schools which were not even mentioned in the legislation at all.

Thanks to her Veto stamp, Students and Teachers will continue to be faced with the decision of getting an education in a defenseless victim zone here in Arizona, or moving to another state like Utah or Colorado where they are free to be prepared to defend their own life if they are threatened by an armed rapist or thug while they happen to be on the grounds of a University or College campus. The criminals either don't know how to read the gun free zone signs, or they simply have been choosing to ignore them. When you're in the dark, alone, and confronted by an armed thug, do you want to be armed with a gun or a cell phone? The gun would be right there at your side in your holster ready to go. The Police would be minutes away, likely to arrive in time only to draw outlines of chalk where they found the bodies of the disarmed victims at the scene of the crime.

The Gun Free Zone experiment is a dismal failure, which has turned competent individuals into helpless disarmed victims. It is well past time for us to stop treating our students and teachers like lab rats. They should be given back their natural right to choose whether or not they wish to be prepared to defend themselves, or to walk around with nothing but a cell phone in their pocket.

AZ: Ask Governor Brewer to Sign Campus Carry

From AZCDL:

Your Action Center letter to the Governor is waiting for you here:
http://capwiz.com/azcdl/issues/alert/?alertid=40883501 .

SB 1467, the AzCDL-requested Campus Carry bill passed out of the House on April 7, 2011 and was sent back to the Senate where it was forwarded to the Governor for her consideration.

SB 1467 simply prevents the governing boards of colleges and universities from prohibiting the “lawful possession or carrying of a weapon on a public right-of-way.” That covers streets, sidewalks, etc. open to public use.

We are already getting word that the anti-rights forces have begun contacting the Governor urging her to veto SB 1467 to make sure that campuses remain safe havens for criminals and dangerous places for students.

The anti-rights crowd has pulled out all the stops this year to prevent teachers, staff, and students in Arizona from having a safe learning environment. East Coast based national groups have beefed up their staff in Arizona. At the Capitol, they have spared no expense on lobbying, including holding a closed meeting with “freshmen” legislators (AzCDL tried to attend but we were stopped at the door). On college and university campuses, they have conducted a series of fear-mongering indoctrination sessions, disguised as “forums,” to stop Campus Carry. Sadly, they have also exploited the victims of the January Tucson shooting tragedy in order to intimidate nervous legislators.

Contact the Governor and let her know that you support the passage of SB 1467 and urge her to sign SB 1467 into law. Your Action Center letter to the Governor is waiting for you here:

AZCDL: Contact House Leadership

From AZCDL:

Much to the delight of anti-rights legislators and criminal empowerment groups, nearly all the House sponsored pro-rights firearms bills have languished without committee assignments or hearings. Meanwhile similar bills have moved swiftly through the Senate and are now under the control of House Leadership.

Your action is needed to ensure that the Senate bills are acted on.

The following Senate Bills have been assigned to the House Judiciary Committee.

SB 1201, the AzCDL-requested bill that says that if a state or local government building or event is going to post a "No Firearms" sign, then security measures must be in place to ensure that no one is capable of bringing in a firearm without detection.

SB 1391, a bill that would authorize and direct the Governor to enter into interstate compacts with other states that have a “Firearms Freedom Act” like the one that was passed last year in Arizona.

SB 1469, a bill that would strengthen current self-defense statutes by broadening the allowance for the use of force and provide greater protection for those forced tdefend themselves from an attacker.

The committee members need to hear from you, politely urging them to support these bills. A letter has been prepared, addressed to all committee members, and is waiting for you at our Legislative Action Center:
http://capwiz.com/azcdl/issues/alert/?alertid=36472501
Feel free to add text, or send it “as is.” When you are done, complete the “Sender Information” and click on “Send Message.”

Also in the House are the following pro-rights bills that the House Leadership has not yet assigned to a committee. Since House rules impose deadlines on committee hearings, we hope they are not trying to “run out the clock” by delaying assignments until the deadlines have passed.

SB 1467, the AzCDL-requested Campus Carry bill.

SB 1610, a bill that would establish the Colt Single Action Army Revolver as the state firearm.

SCR 1020, a proposed Constitutional Amendment that would protect crime victims from law suits by those who harm them. Assuming it passes out of the legislature, SCR 1020 will be sent to the Secretary of State to be placed on the ballot.

The House Leadership needs to hear from you, politely urging them to assign these bills to the appropriate committees right away. A letter has been prepared, addressed to the entire House Leadership, and is waiting for you at our Legislative Action Center:
http://capwiz.com/azcdl/issues/alert/?alertid=36503501
Feel free to edit the text, or send it “as is.” When you are done, complete the “Sender Information” and click on “Send Message.”

The time for action is now! Your freedom depends on it.

Stay tuned! When critical legislation moves, we will notify you via these Alerts.

AZ: NRA-ILA Legislative Alert

From the NRA-ILA:

Tuesday, March 15, 2011

Session continues in Phoenix and several bills reported previously need your support. The House Judiciary Committee is set to consider two bills important to not only Arizona’s firearm owners.

As reported last week, Senate Bill 1201 passed in the Senate on its final reading by a vote of 21 to 8, with one absent. This pro-gun bill is a comprehensive firearms reform measure which would make a number of improvements to Arizona’s carry laws. Most importantly, it would help put an end to “gun free” signs limiting your right to carry in most currently prohibited places and unsecured buildings. This reasonable right-to-carry reform legislation is designed to prohibit the arbitrary lines created by these signs which currently restrict your right to self-defense.

Also, Senate Bill 1469 had its first reading in the House yesterday and was referred to the House Judiciary Committee for consideration. This important self-defense reform would strengthen the current “Castle Doctrine” self-defense law by broadening the definition of reasonable use of force, including deadly force, to provide greater protection for those forced to defend themselves from an attacker.

Please contact members of the House Judiciary Committee listed here and respectfully urge them to vote in favor of SB 1201 and SB 1469.

Yesterday, the full Senate passed Senate Bill 1467 by a 21 to 7 vote, with two votes absent. With an NRA-backed amendment attached, SB 1467 would prohibit an educational institution from adopting or enforcing any policy prohibiting the possession of a concealed weapon by a permit holder or regulating the lawful transportation or storage of a firearm. SB 1467 will now move to the House for its next committee assignment.

On Monday, March 14, House Bill 2645 successfully passed out of the Senate Judiciary Committee by a vote of 7 to 1. The bill is designed to meet the requirements of the federal NICS Improvement Amendments Act of 2007 by enabling persons who have lost their firearm rights because of a mental health-related commitment or adjudication to petition a court to have them restored. Before granting a petition, the court would have to find that the person is not likely to act in a manner that is dangerous to public safety and that granting the requested relief would not be contrary to the public interest. This bill will ensure that people who can safely and responsibly possess firearms are not unnecessarily deprived of their rights.

HB 2645 now moves to the Senate floor to be scheduled for a vote by the full chamber.

Please keep checking your e-mail and www.NRAILA.org for further updates on SB 1467 and HB 2645.

AZ 2011 Bills

There are a lot of great firearm related bills being considered in Arizona this year. There are also some bad firearm related bills. You can keep track of all of them from directly from the AZCDL 2011 Legislation Page. Each bill has a brief description and notes whether the AZCDL supports, opposes, or is neutral on the bill. It also has a link to the Arizona Legislature website with current bill status information such as bill text, votes, and even video of any related floor debates or committee hearings.

AZ Campus Carry HB 2014

Representative Harper has filed Campus Carry HB 2014 for the 2011 Arizona Legislative Session.

Below is the key text of HB 2014:
NOTWITHSTANDING SUBSECTION D OF THIS SECTION, THE GOVERNING BOARD OF ANY UNIVERSITY, COLLEGE OR COMMUNITY COLLEGE SHALL NOT ENACT OR ENFORCE ANY POLICY OR RULE THAT PROHIBITS THE POSSESSION OF A CONCEALED WEAPON BY A PERSON WHO POSSESSES A VALID PERMIT RECOGNIZED OR ISSUED PURSUANT TO SECTION 13-3112 OR THE TRANSPORTATION OR STORAGE OF A FIREARM PURSUANT TO SECTION 12‑781.
Optimally I'd rather not have the CCW permit requirement, but that provision may be required to get the bill passed. You could think of this as a football game that we're winning, and we're trying for another 1st down as we fight towards the ultimate goal of fully restoring our freedoms.

Be sure to contact your representatives to ask for their support. It is high time we eliminate the existing defenseless victim zones at Arizona Colleges and Universities. The so-called "Gun Free Zone" is now well proven to be a failed experiment which has been utilizing our students and faculty as defenseless lab rats, many of which have paid the ultimate price. Although Liberal Progressives dream of it, I have yet to hear of a single Rapist, Murderer, or Criminal Psychopath who has actually disarmed himself voluntarily simply because he saw a Gun Free Zone sign posted on a wall.

You can read some of Representative Harper's comments on the bill at verdenews.com

Alan Korwin: Gun Limits Lifted

As you are no doubt aware, Americans in Arizona are now enjoing expanded freedoms due to the fact that additional unconstitutional infringements of our right to bear arms were removed a week ago on July 29th when a number of new laws went into effect. Alan Korwin wrote an excellent article in celebration of our expanded freedoms, definitely worth reading.

John Grady: Essay on Constitutional Carry

John Grady was kind enough to share with us an essay he wrote for his College Class on the topic of Arizona's new Constitutional Carry law:

Arizona Concealed Carry

Arizona has much history involving the “Wild West”; Doc Holiday, Wyatt, Vigil, and Morgan Earp, “gun-slinging”, and the shoot-out at the O.K. Corral. On July 29, 2010, many believe this day will be ushering in the reincarnation of the Wild West. From this date forward, any US citizen in the state of Arizona, age 21 and older with no felonies on record may carry a concealed firearm without a permit. This new law has raised many questions, and is in many ways controversial. Is it a bad idea? What kind of change will we see in society, if any? Will we see more crime or less? Let us analyze the concept of carrying a concealed firearm, potential scenarios where this new law may come into play, and our Second Amendment rights.

You may be asking yourself, “What is the definition of ‘Concealed Carry’?” Concealed carry is when an individual carries a firearm, specifically a handgun, on their person in a manner that is unseen by the public eye. Before this new law, it is an illegal act to carry a firearm in a concealed fashion without a license, punishable by incarceration for up to six months, and a fine of up to $2500. To obtain this license, one must be at least 21 years of age and go through an 8 hour course that includes subjects on use of force, legality, concealing techniques, and shooting qualification at the shooting range. Additionally, one must be able to pass a background check.

The requirement of a license has kept a very small amount of control over criminal activity in which a concealed handgun was involved. As we see in society today, gun laws never effect the “bad guys”. Many individuals involved in crime, organized or not, are obviously not concerned in upholding the law, but rather breaking it and thus not concerned with taking the time or paying the cost of getting a concealed carry license... Not to mention the fact that most have at least one felony on their record, disqualifying them from being able to receive a license in the first place. This means that when one of these individuals are caught with a concealed firearm, they are put behind bars. But what happens when one of these jailbirds gets out of prison? A recent study by the Criminal Justice Reform Coalition shows that over half the individuals that get out of jail go right back to committing crimes and end up being thrown back in prison again. As many of you who watch the news and read the newspaper can see, this is just an endless cycle. The majority of these gangsters carry a firearm in an illegal, concealed fashion on a daily basis.

Where does this leave the citizens who uphold the law, but don’t have the time or the money to go through the course? Where does this leave the gentleman who is just buying a pack of smokes when an armed gunman decides to hold up the Circle-K? He can’t exactly defend himself or others with a box of Marlboro “Reds”. What about the woman who is just walking to her car in a dark parking lot at night when a potential rapist corners her? What happens when her pepper spray isn’t enough? Maybe she owns a pistol but doesn’t have it in her purse to protect herself with because she is in a situation in which she doesn’t have the money or time to get her license. This, in my opinion, is a violation of our Second Amendment right to bear arms and to protect ourselves. Many people find themselves in similar situations. Many people own a firearm, but don’t have a concealed carry license. Now, with this new law, a law-abiding citizen may conceal a firearm on their person without the once required license, and have a chance to defend themselves, should they find themselves in a less than favorable situation.

Could this new law create a safer environment? I most certainly believe it can, and will. An armed and ready public can discourage a vast majority of criminal acts, from robbery, to violent crimes and rape. In Arizona, you will see a drop in crime rates, because now there is the “Unknown Factor” that the crook has to worry about. Before the individual commits a crime, s/he will have to consider that many of the people present could be carrying a concealed weapon. The whole room could be concealing a firearm, which makes for some very unfavorable odds if you are about to rob the place.

Kennesaw, Georgia provides a perfect example of what this law can do for the public. In March 1982, the small town passed an ordinance requiring each head of household to own and maintain a gun. Since then, despite similar predictions of "Wild West" showdowns, increased violence and accidents we are hearing now, not a single resident has been involved in a fatal shooting. That’s 28 years murder-free, as compared to Morton Grove, Illinois, who adopted a gun ban for everyone other than police, and witnessed their crime rate go up 15.7% despite predictions of the opposite occurring.

This new law, in my opinion will employ the “Sheepdog Concept”, as Lt. Col. Dave Grossman puts it in his book “On Combat”. The Sheepdog Concept is where the “sheepdog”, or protector in this scenario, sees a “sheep”, or victim, suffering an injustice or a violent crime by a “wolf”, or perpetrator. The sheepdog cannot just stand by and watch, but must step in to protect the sheep from the wolf. The sheepdog cannot abide with injustice. Don’t confuse the Sheepdog Concept with vigilantism. We aren’t talking about the Boondock Saints here. The sheepdogs of society don’t go looking for trouble, but are ready, should they encounter it. For instance, a man who is carrying a concealed firearm under this new law, witnesses a woman being robbed at gunpoint. The man decides to step in and use his firearm to save the woman, and possibly preserve her life. Now that people may carry concealed, I believe it will give many a feeling that they can have an impact and actually make a difference in a similar situation because they have the tool at their disposal to do so with.

In December 2007, Matthew J. Murray, an armed gunman, killed multiple individuals at a youth center in Arvada, California. He then proceeded to drive to New Life Church in Colorado Springs to do the same. When he arrived at the church, he pulled out his firearm and open fired in the parking lot and the foyer, killing two people and wounding three. Out of hundreds of people present, Jeanne Assam had a concealed carry license and a pistol in her purse. She drew it from her purse and shot Murray multiple times, wounding him so severely that he ended up taking his own life. This woman was prepared for a day that she probably thought she would never see. This woman was a sheepdog and she could not abide with the injustice this gunman was inflicting. She saved lives that day. Imagine if a large portion of the population was prepared in such a manner. Would the gunman have even considered pulling this move with the “Unknown Factor”? Even if he did, he most likely wouldn’t have made it out of the Youth Center he shot up.

With the new law, we are seeing support of our Second Amendment right that hasn’t been in play since the early 1900’s. This law is a major restoration of our principal right to defend ourselves and the lives of others. It is pertinent that we exercise our right to bear arms, now that a huge portion of it is being given back to us. I encourage everyone who is going to utilize this new law to be responsible, and to educate yourself on the legal aspects on use of force, as well as the types of establishments in which you can and cannot carry your weapon. You can find this information on Arizona’s Department of Public safety website. I also encourage you to go out to the shooting range and practice, so if you ever see a day in which you may have to use your weapon (and I pray you never see that day), your shots will be precise and well placed. Don’t be afraid to carry a concealed weapon!

Free Ben Avery Shooting Classes

Ben Avery has a host of free introductory shooting classes. One of their programs, Desert Roses, is a clay target shotgun class exclusively for women. I have a friend who has attended a number of the Desert Roses classes and really enjoyed them. As an added bonus, the Ben Avery Clay Target Center is world class. AZCentral recently wrote an article about the Desert Roses program, and below is an embedded video about the Desert Roses program aired on Fox 10 news.

My boys and I LOVE the Ben Avery sporting clays courses. Sporting Clays is a bit like golf for shotguns, only much more fun than plain old golf. You walk from one target stand to the next, each with a unique method of throwing the clay targets. One of our favorite stops along the course is the bunny rabbit stand - a clay target bounces along the ground, simulating a bunny rabbit on the run. It is so much fun to hit that orange rascally rabbit and watch it explode. If you don't yet own a shotgun, they have a limited number of free shotgun loaners available, and additional shotguns are available for rent if their free loaners are all in use. You really have to try it to find out for yourself how much fun you've been missing!

AZ: NRA Open Range Day at Ben Avery

The NRA is hosting an Open Range Day on May 8, 2010 at Ben Avery:

FAIRFAX, VA – The Disabled Shooting Services of the National Rifle Association is proud to announce the second annual Open Range Day at the Ben Avery Shooting Facility in Phoenix, Arizona, on May 8, 2010. Open Range Day is an all inclusive event where certified trainers and instructors introduce a wide variety of shooting sports to people with physical disabilities.

"We had a huge response from first-time shooters last year," said Disabled Shooting Services Manager Vanessa Ross. "Registration for 2010 is already twice the size of last year's class, and we can’t wait to get things started."

Open Range Day begins with a safety clinic led by NRA Certified Instructors. Participants then have the opportunity to learn the proper way to shoot shotguns, rifles, pistols, and air guns. "The important thing is for everyone to explore their personal potential on the range and simply have fun," explained Ross.

The event is made possible through the generous donation of time and materials. In addition to the numerous volunteers who will be on hand to guide the shooters, companies like Ruger, White Flyer, and Davidson's have graciously donated materials.

"We wouldn’t be able to hold such an event without our corporate sponsors,” said Ross. “Ruger, Savage, and Davidson's are donating the use of their firearms, White Flyer Targets and Birchwood Casey are donating targets, while Kowa Optimed, Pyramyd Air, Lapua and Remington are donating spotting scopes and ammunition."

For more info on Open Range Day, contact Vanessa Ross at (703) 267-1495 or e-mail: Disabled-shooting@nrahq.org. To learn about NRA’s disabled shooting programs, visit http://www.nrahq.org/compete/disabled.asp.

AZ: Governor Brewer Signed Constitutional Carry!

It's official. Arizona joined Alaska & Vermont in recognizing the right to bear arms as protected by the Second Amendment this afternoon when Governor Brewer signed SB 1108 into law. Although you are still free to apply for an Arizona CCW permit to receive reciprocity in States that recognize it, you will no longer be required to ask the Arizona State Police for their permission to bear arms in defense of yourself and your families once this law takes effect this fall (on July 28, 2010), even if your gun happens to be covered by your shirt or jacket. The current legislative session is expected to end in the next few weeks, so this law should take effect sometime in late July or early August. Watch this post as I'll update it with the effective date once it is official (July 28, 2010).

This is a great day for freedom in Arizona. Here is a link to the press release from Governor Brewer. Be sure to send her a note to say thanks for supporting Freedom.

Update 5: The 49th Legislature, 2nd Regular Session Adjourned on Thursday, April 29, 2010. As a result, Constitutional Carry will take effect on Thursday, July 29, 2010

AZ: Firearms Freedom Act Signed into Law

HB 2307, Arizona's version of the Firearms Freedom Act was signed into law today by Governor Brewer. This is good news for Arizonans, as we join 5 other States who have already passed similar bills, and roughly two dozen other States who are currently considering them. It's a great way for Arizona to tell the Feds that they need to stay within the bounds of the US Constitution and leave our State alone. The Federal Government has gone way beyond the original intent of the Commerce Clause of the Constitution and has been treading we the People under their muddy boots. It is time for us to bring a well overdue end to their arrogance.

HB 2543, State Firearms Preemption, was also signed into law by Governor Brewer.

An excerpt of the new Arizona State Firearms Preemption law is below:
"A. Except as provided in subsection D of this section, a political subdivision of this state shall not enact any ordinance, rule or tax relating to the transportation, possession, carrying, sale, transfer, PURCHASE, ACQUISITION, GIFT, DEVISE, STORAGE, LICENSING, REGISTRATION, DISCHARGE or use of firearms or ammunition or any firearm or ammunition components OR RELATED ACCESSORIES in this state."

AZ: Constitutional Carry Passed in Senate - Next Stop: House

Watch the video archive. Check out the related NRA-ILA alert. Below details are from AZCDL:

First, the good news! SB 1108, the Senate version of the AzCDL-requested Constitutional Carry bill, passed in the Senate Third Read, by a 20-10 vote, on Monday, March 29, 2010. Your emails work!

From here, SB 1108 will be sent over to the House. Since the House has already voted for an identical bill, HB 2347, during their Committee of the Whole (COW) debate, we are expecting SB 1108 to be substituted for HB 2347 during the House Third Read. We are also expecting the House Third Read vote to be as early as [Wednesday, March 31, 2010]. This will be “the” final vote on Constitutional Carry to determine if it will be sent to the Governor!

AzCDL’s representatives are at the Capitol daily counting potential votes and talking to the undecided. However, what will determine the successful passage of SB 1108 are YOUR emails. Your letter, to send to your Representatives, has been prepared and is waiting for you at AzCDL’s Action Center:
http://capwiz.com/azcdl/issues/alert/?alertid=14824091 .

We would also appreciate it if you took the time to contact Senators Carolyn Allen, Steve Pierce, Rebecca Rios and Jay Tibshraeny and thank them for supporting SB 1108 during the Senate Third Read. They were 4 of the 5 Senators who supported the Cheuvront amendment that ended the progress of SB 1102, the original Senate Constitutional Carry bill. After receiving hundreds of your emails they voted for SB 1108. Please go to AzCDL Action Center and send these Senators a note of thanks:
http://capwiz.com/azcdl/issues/alert/?alertid=14879796 .

SB 1168, the Firearms Preemption bill, was also scheduled for a Senate Third Read vote on March 29th. However it was held pending a House vote on HB 2543, the House version of Firearms Preemption. During the House Third Read, also on March 29th, HB 2543 passed by a 36-21 vote with 3 Representatives not voting. It will soon be sent to the Senate and substituted for SB 1168 in an upcoming Senate Third Read. Like the situation with Constitutional Carry, this should be the final vote before sending the bill to the Governor.

Finally, HB 2307, the Firearms Freedom Act, also passed out of the Senate Third Read on March 29th by a 22-8 vote. From here it will go back to the House (a formality) before being sent to the Governor.

Stay tuned! When critical legislation moves, we will notify you via these Alerts.
