Another try for Campus Carry

Patriotic Senator Ron Gould plans to introduce legislation on Monday that would remove current restrictions for students who poses CCW permits while they are on Arizona College Campuses. I'd love to see an even broader bill, but based on past results this is likely the best first step. Please contact Senator Gould and let him know that you support his efforts. He is currently facing an onslaught of left wing anti-gun media coverage claiming that the sky would fall and blood would run in the streets if 21 year old adults who already have CCW permits and already carry a gun everywhere else in the State were suddenly no longer prohibited from defending themselves while they happen to be in yet another so-called "Gun Free Zone"

For those who think Gun Free Zones work, just ask the victims of the Virginia Tech Gun Free Zone how well the zone worked for them. The simple truth is that criminals, rapists, and crazy people do not obey gun free zone signs any more than they would obey a smoke free zone or a no parking zone. They simply ignore them. The people victimized by gun free zones time and time again are the defenseless victims trapped within them.

John R Lott Jr on HR 822

John R. Lott Jr posted a great article about HR 822 titled "What's Wrong With Making It Easier to Carry a Gun Across State Lines?"

Take a look at HR 822, it is straight forward, essentially similar to existing Federal law that tells States that they must recognize drivers licenses issued by other States. HR 822 tells States that if they issue concealed carry permits, they must recognize concealed carry permits issued by other States. It is only a few paragraphs long, and is so simple that even my 5th grader understandood it. Really. I had him read it and explain it to verify my theory.

Governor Brewer Vetoes Campus Carry

In her veto letter yesterday afternoon, Governor Brewer claimed that she vetoed SB 1467 because she was concerned that the public right of way specified in the legislation was not properly defined within it. Is it just me, or does it seem fairly simple to you? If it's a sidewalk or a parking lot, and the public has the right to be there, then it is a public right of way area. If it's a place the general public is not allowed to be, it is not a public right of way area.

That is so simple even a 5th grader can understand it, but apparently it was too difficult for our Governor even with her entire staff to help her out. If they failed to help her figure it out, all she had to do was call me, and I would have been happy to give her a hand. I even happen to have a 6th grader here at home who could have helped her in a pinch if I was too busy at the moment.

She also gave a lame excuse about K-12 schools which were not even mentioned in the legislation at all.

Thanks to her Veto stamp, Students and Teachers will continue to be faced with the decision of getting an education in a defenseless victim zone here in Arizona, or moving to another state like Utah or Colorado where they are free to be prepared to defend their own life if they are threatened by an armed rapist or thug while they happen to be on the grounds of a University or College campus. The criminals either don't know how to read the gun free zone signs, or they simply have been choosing to ignore them. When you're in the dark, alone, and confronted by an armed thug, do you want to be armed with a gun or a cell phone? The gun would be right there at your side in your holster ready to go. The Police would be minutes away, likely to arrive in time only to draw outlines of chalk where they found the bodies of the disarmed victims at the scene of the crime.

The Gun Free Zone experiment is a dismal failure, which has turned competent individuals into helpless disarmed victims. It is well past time for us to stop treating our students and teachers like lab rats. They should be given back their natural right to choose whether or not they wish to be prepared to defend themselves, or to walk around with nothing but a cell phone in their pocket.

AZ: Ask Governor Brewer to Sign Campus Carry

From AZCDL:

Your Action Center letter to the Governor is waiting for you here:
http://capwiz.com/azcdl/issues/alert/?alertid=40883501 .

SB 1467, the AzCDL-requested Campus Carry bill passed out of the House on April 7, 2011 and was sent back to the Senate where it was forwarded to the Governor for her consideration.

SB 1467 simply prevents the governing boards of colleges and universities from prohibiting the “lawful possession or carrying of a weapon on a public right-of-way.” That covers streets, sidewalks, etc. open to public use.

We are already getting word that the anti-rights forces have begun contacting the Governor urging her to veto SB 1467 to make sure that campuses remain safe havens for criminals and dangerous places for students.

The anti-rights crowd has pulled out all the stops this year to prevent teachers, staff, and students in Arizona from having a safe learning environment. East Coast based national groups have beefed up their staff in Arizona. At the Capitol, they have spared no expense on lobbying, including holding a closed meeting with “freshmen” legislators (AzCDL tried to attend but we were stopped at the door). On college and university campuses, they have conducted a series of fear-mongering indoctrination sessions, disguised as “forums,” to stop Campus Carry. Sadly, they have also exploited the victims of the January Tucson shooting tragedy in order to intimidate nervous legislators.

Contact the Governor and let her know that you support the passage of SB 1467 and urge her to sign SB 1467 into law. Your Action Center letter to the Governor is waiting for you here:

AZCDL: Contact House Leadership

From AZCDL:

Much to the delight of anti-rights legislators and criminal empowerment groups, nearly all the House sponsored pro-rights firearms bills have languished without committee assignments or hearings. Meanwhile similar bills have moved swiftly through the Senate and are now under the control of House Leadership.

Your action is needed to ensure that the Senate bills are acted on.

The following Senate Bills have been assigned to the House Judiciary Committee.

SB 1201, the AzCDL-requested bill that says that if a state or local government building or event is going to post a "No Firearms" sign, then security measures must be in place to ensure that no one is capable of bringing in a firearm without detection.

SB 1391, a bill that would authorize and direct the Governor to enter into interstate compacts with other states that have a “Firearms Freedom Act” like the one that was passed last year in Arizona.

SB 1469, a bill that would strengthen current self-defense statutes by broadening the allowance for the use of force and provide greater protection for those forced tdefend themselves from an attacker.

The committee members need to hear from you, politely urging them to support these bills. A letter has been prepared, addressed to all committee members, and is waiting for you at our Legislative Action Center:
http://capwiz.com/azcdl/issues/alert/?alertid=36472501
Feel free to add text, or send it “as is.” When you are done, complete the “Sender Information” and click on “Send Message.”

Also in the House are the following pro-rights bills that the House Leadership has not yet assigned to a committee. Since House rules impose deadlines on committee hearings, we hope they are not trying to “run out the clock” by delaying assignments until the deadlines have passed.

SB 1467, the AzCDL-requested Campus Carry bill.

SB 1610, a bill that would establish the Colt Single Action Army Revolver as the state firearm.

SCR 1020, a proposed Constitutional Amendment that would protect crime victims from law suits by those who harm them. Assuming it passes out of the legislature, SCR 1020 will be sent to the Secretary of State to be placed on the ballot.

The House Leadership needs to hear from you, politely urging them to assign these bills to the appropriate committees right away. A letter has been prepared, addressed to the entire House Leadership, and is waiting for you at our Legislative Action Center:
http://capwiz.com/azcdl/issues/alert/?alertid=36503501
Feel free to edit the text, or send it “as is.” When you are done, complete the “Sender Information” and click on “Send Message.”

The time for action is now! Your freedom depends on it.

Stay tuned! When critical legislation moves, we will notify you via these Alerts.

AZ: NRA-ILA Legislative Alert

From the NRA-ILA:

Tuesday, March 15, 2011

Session continues in Phoenix and several bills reported previously need your support. The House Judiciary Committee is set to consider two bills important to not only Arizona’s firearm owners.

As reported last week, Senate Bill 1201 passed in the Senate on its final reading by a vote of 21 to 8, with one absent. This pro-gun bill is a comprehensive firearms reform measure which would make a number of improvements to Arizona’s carry laws. Most importantly, it would help put an end to “gun free” signs limiting your right to carry in most currently prohibited places and unsecured buildings. This reasonable right-to-carry reform legislation is designed to prohibit the arbitrary lines created by these signs which currently restrict your right to self-defense.

Also, Senate Bill 1469 had its first reading in the House yesterday and was referred to the House Judiciary Committee for consideration. This important self-defense reform would strengthen the current “Castle Doctrine” self-defense law by broadening the definition of reasonable use of force, including deadly force, to provide greater protection for those forced to defend themselves from an attacker.

Please contact members of the House Judiciary Committee listed here and respectfully urge them to vote in favor of SB 1201 and SB 1469.

Yesterday, the full Senate passed Senate Bill 1467 by a 21 to 7 vote, with two votes absent. With an NRA-backed amendment attached, SB 1467 would prohibit an educational institution from adopting or enforcing any policy prohibiting the possession of a concealed weapon by a permit holder or regulating the lawful transportation or storage of a firearm. SB 1467 will now move to the House for its next committee assignment.

On Monday, March 14, House Bill 2645 successfully passed out of the Senate Judiciary Committee by a vote of 7 to 1. The bill is designed to meet the requirements of the federal NICS Improvement Amendments Act of 2007 by enabling persons who have lost their firearm rights because of a mental health-related commitment or adjudication to petition a court to have them restored. Before granting a petition, the court would have to find that the person is not likely to act in a manner that is dangerous to public safety and that granting the requested relief would not be contrary to the public interest. This bill will ensure that people who can safely and responsibly possess firearms are not unnecessarily deprived of their rights.

HB 2645 now moves to the Senate floor to be scheduled for a vote by the full chamber.

Please keep checking your e-mail and www.NRAILA.org for further updates on SB 1467 and HB 2645.

AZ 2011 Bills

There are a lot of great firearm related bills being considered in Arizona this year. There are also some bad firearm related bills. You can keep track of all of them from directly from the AZCDL 2011 Legislation Page. Each bill has a brief description and notes whether the AZCDL supports, opposes, or is neutral on the bill. It also has a link to the Arizona Legislature website with current bill status information such as bill text, votes, and even video of any related floor debates or committee hearings.

AZ Campus Carry HB 2014

Representative Harper has filed Campus Carry HB 2014 for the 2011 Arizona Legislative Session.

Below is the key text of HB 2014:
NOTWITHSTANDING SUBSECTION D OF THIS SECTION, THE GOVERNING BOARD OF ANY UNIVERSITY, COLLEGE OR COMMUNITY COLLEGE SHALL NOT ENACT OR ENFORCE ANY POLICY OR RULE THAT PROHIBITS THE POSSESSION OF A CONCEALED WEAPON BY A PERSON WHO POSSESSES A VALID PERMIT RECOGNIZED OR ISSUED PURSUANT TO SECTION 13-3112 OR THE TRANSPORTATION OR STORAGE OF A FIREARM PURSUANT TO SECTION 12‑781.
Optimally I'd rather not have the CCW permit requirement, but that provision may be required to get the bill passed. You could think of this as a football game that we're winning, and we're trying for another 1st down as we fight towards the ultimate goal of fully restoring our freedoms.

Be sure to contact your representatives to ask for their support. It is high time we eliminate the existing defenseless victim zones at Arizona Colleges and Universities. The so-called "Gun Free Zone" is now well proven to be a failed experiment which has been utilizing our students and faculty as defenseless lab rats, many of which have paid the ultimate price. Although Liberal Progressives dream of it, I have yet to hear of a single Rapist, Murderer, or Criminal Psychopath who has actually disarmed himself voluntarily simply because he saw a Gun Free Zone sign posted on a wall.

You can read some of Representative Harper's comments on the bill at verdenews.com

Alan Korwin: Gun Limits Lifted

As you are no doubt aware, Americans in Arizona are now enjoing expanded freedoms due to the fact that additional unconstitutional infringements of our right to bear arms were removed a week ago on July 29th when a number of new laws went into effect. Alan Korwin wrote an excellent article in celebration of our expanded freedoms, definitely worth reading.

IA: Iowa Becomes 41st Shall Issue State

Iowa Governor Chet Culver Signed their Shall Issue Concealed Carry bill (SF-2379) into Law today, making Iowa the 41st State to mandate that all concealed carry applicants be treated equally under the law rather than subject to subjective case by case determinations by their local Sheriff as still occurs in the remaining "may issue" States. The new law will take effect January 1st 2011.

Congratulations Iowa!

Additionally, Iowa will honor all Concealed Carry permits issued by other States which will allow me to actually visit Iowa some day. Currently they don't recognize any out of State permits, so this will be a wonderful change! I've heard that Iowa is a nice place to visit, if you didn't mind giving up your right to defend yourself and your family while visiting. That problem will be gone starting in 2011.

Gene German has additional details.

AZ: Governor Brewer Signed Constitutional Carry!

It's official. Arizona joined Alaska & Vermont in recognizing the right to bear arms as protected by the Second Amendment this afternoon when Governor Brewer signed SB 1108 into law. Although you are still free to apply for an Arizona CCW permit to receive reciprocity in States that recognize it, you will no longer be required to ask the Arizona State Police for their permission to bear arms in defense of yourself and your families once this law takes effect this fall (on July 28, 2010), even if your gun happens to be covered by your shirt or jacket. The current legislative session is expected to end in the next few weeks, so this law should take effect sometime in late July or early August. Watch this post as I'll update it with the effective date once it is official (July 28, 2010).

This is a great day for freedom in Arizona. Here is a link to the press release from Governor Brewer. Be sure to send her a note to say thanks for supporting Freedom.

Update 5: The 49th Legislature, 2nd Regular Session Adjourned on Thursday, April 29, 2010. As a result, Constitutional Carry will take effect on Thursday, July 29, 2010

AZ: Constitutional Carry Passed!

The Arizona House of Representatives passed SB 1108 Constitutional Carry this afternoon by a vote of 36 to 19 with 5 abstaining. This is great news for Freedom Lovers all across the US, and especially for those of us live in or visit Arizona.

Next stop, Governor Brewer's desk. Send her an e-mail and ask for her support.

AZ: Constitutional Carry Scheduled for Final Vote

AZCDL & the NRA-ILA have informed me that SB 1108 Constitutional Carry is scheduled for a final vote in the House tomorrow. Be sure to contact your representatives to ask for their support as the vote is expected to be a close one and they need to hear from you. It has already passed in the Senate so if passed in the House tomorrow it will then head to the Governor for her signature.

AZ: Firearms Freedom Act Signed into Law

HB 2307, Arizona's version of the Firearms Freedom Act was signed into law today by Governor Brewer. This is good news for Arizonans, as we join 5 other States who have already passed similar bills, and roughly two dozen other States who are currently considering them. It's a great way for Arizona to tell the Feds that they need to stay within the bounds of the US Constitution and leave our State alone. The Federal Government has gone way beyond the original intent of the Commerce Clause of the Constitution and has been treading we the People under their muddy boots. It is time for us to bring a well overdue end to their arrogance.

HB 2543, State Firearms Preemption, was also signed into law by Governor Brewer.

An excerpt of the new Arizona State Firearms Preemption law is below:
"A. Except as provided in subsection D of this section, a political subdivision of this state shall not enact any ordinance, rule or tax relating to the transportation, possession, carrying, sale, transfer, PURCHASE, ACQUISITION, GIFT, DEVISE, STORAGE, LICENSING, REGISTRATION, DISCHARGE or use of firearms or ammunition or any firearm or ammunition components OR RELATED ACCESSORIES in this state."

AZ: Constitutional Carry Passed in Senate - Next Stop: House

Watch the video archive. Check out the related NRA-ILA alert. Below details are from AZCDL:

First, the good news! SB 1108, the Senate version of the AzCDL-requested Constitutional Carry bill, passed in the Senate Third Read, by a 20-10 vote, on Monday, March 29, 2010. Your emails work!

From here, SB 1108 will be sent over to the House. Since the House has already voted for an identical bill, HB 2347, during their Committee of the Whole (COW) debate, we are expecting SB 1108 to be substituted for HB 2347 during the House Third Read. We are also expecting the House Third Read vote to be as early as [Wednesday, March 31, 2010]. This will be “the” final vote on Constitutional Carry to determine if it will be sent to the Governor!

AzCDL’s representatives are at the Capitol daily counting potential votes and talking to the undecided. However, what will determine the successful passage of SB 1108 are YOUR emails. Your letter, to send to your Representatives, has been prepared and is waiting for you at AzCDL’s Action Center:
http://capwiz.com/azcdl/issues/alert/?alertid=14824091 .

We would also appreciate it if you took the time to contact Senators Carolyn Allen, Steve Pierce, Rebecca Rios and Jay Tibshraeny and thank them for supporting SB 1108 during the Senate Third Read. They were 4 of the 5 Senators who supported the Cheuvront amendment that ended the progress of SB 1102, the original Senate Constitutional Carry bill. After receiving hundreds of your emails they voted for SB 1108. Please go to AzCDL Action Center and send these Senators a note of thanks:
http://capwiz.com/azcdl/issues/alert/?alertid=14879796 .

SB 1168, the Firearms Preemption bill, was also scheduled for a Senate Third Read vote on March 29th. However it was held pending a House vote on HB 2543, the House version of Firearms Preemption. During the House Third Read, also on March 29th, HB 2543 passed by a 36-21 vote with 3 Representatives not voting. It will soon be sent to the Senate and substituted for SB 1168 in an upcoming Senate Third Read. Like the situation with Constitutional Carry, this should be the final vote before sending the bill to the Governor.

Finally, HB 2307, the Firearms Freedom Act, also passed out of the Senate Third Read on March 29th by a 22-8 vote. From here it will go back to the House (a formality) before being sent to the Governor.

Constitutional Carry Scheduled for Senate COW Debate

From AZCDL:

Your immediate action is needed to support SB 1108, the AzCDL-requested Constitutional Carry bill, which eliminates the prohibition and penalties for law-abiding adults who carry a concealed weapon without a permit.

We are expecting SB 1108 to be placed on the Senate Committee of the Whole (COW) agenda for March 23rd (tomorrow!). It is critical that you immediately contact your Senator and urge them to support SB 1108 during the COW debate. A letter is waiting to be sent by you at AzCDL’s Action Center:
http://capwiz.com/azcdl/issues/alert/?alertid=14820506 .

On March 18th both Constitutional Carry bills (SB 1108 & HB 2347) were scheduled for debate in their respective chamber’s Committee of the Whole (COW). Both were pulled from the calendar to be rescheduled, for a very good reason. On March 17th the Governor’s staff requested some minor changes that they felt would improve the chance of Constitutional Carry becoming law. SB 1108 has now been rescheduled for COW debate tomorrow, March 23rd.

If you haven’t sent an email to your Senator on SB 1108 please don’t hesitate any longer. Your letter to send to your Senator is waiting for you at AzCDL’s Action Center.

AZCDL Legislative Update

From AZCDL:

HB 2347, the House version of the AzCDL-requested Constitutional Carry bill, passed out of the House Rules committee on March 8th. Its next stop is the House Committee of the Whole (COW) for debate and voice vote. Unfortunately, bills are added to COW calendars with very little advanced warning, so keep your keyboards ready for an “11th hour” email offensive.

SB 1108, the Senate version of Constitutional Carry, is awaiting a review in the Senate Rules Committee before it progresses to the Senate COW.

We are picking up disinformation that is being spread about the Constitutional Carry bills, so let’s review their features. Article 2, Section 26 of the Arizona Constitution says that your pre-existing right to bear arms “shall not be impaired.” The Constitutional Carry bills restore that right by eliminating the prohibition and penalties currently in place for law-abiding adults who carry a concealed weapon without a CCW permit.

The Constitutional Carry bills also eliminate the confusion in interpreting the statutes regarding open carry and vehicle carry that have been clouded since 1994 by Appellate court decisions. For all practical purposes the only current way to be sure you are legally carrying openly, or in your vehicle, is to have a CCW permit.

The CCW permit becomes optional – it is not eliminated. Training requirements would be broadened to facilitate obtaining the optional permit. The expanded training opportunities include allowing the use of NRA training, proof of military service, college level courses and training from an approved firearms training school (e.g., Gunsite, Front Sight). Since these are similar to requirements in use by Florida and a number of other states, reciprocity should be unaffected.

A CCW permit will still be required to carry concealed into establishments that serve alcohol and to bypass the NICS check when purchasing a firearm from a licensed dealer. Additionally, language has been added in HB 2347 & SB 1108 that exempts CCW permit holders from the requirement to be unarmed when entering a “non-secure” state and local government building. A non-secure building is one that doesn’t have the means to tightly control access by the general public.

The majority of rank and file law enforcement organizations are not opposing the Constitutional Carry bills. Opposition remains from organizations representing the chiefs of police and some county attorneys, primarily political positions.

There are many still working to defeat Constitutional Carry in the legislature. AzCDL is constantly working at the Capitol to count the supporters and influence the fence-sitters. Constitutional Carry has a good chance of becoming law this year, but our success will be totally dependent on YOUR involvement. When legislators hear from you, they get the message. Get ready!

Stay tuned! When critical legislation moves, we will notify you via these Alerts.

AZCDL Legislative Update

From AZCDL:

SB 1102, the Senate version of Constitutional Carry may have been stalled by a few Senate Republicans “crossing the aisle” to vote with Democrats to add the Cheuvront amendment, but that doesn’t mean it’s “game over” for Constitutional Carry in Arizona. We are working with Senator Russell Pearce, the bill’s sponsor, to find a way to move the bill forward in its proper form. There is still hope for the Senate version of the bill.

Even though the situation in the Senate remains tenuous, all is still not lost. AzCDL plans ahead! At the beginning of this session, identical versions of Constitutional Carry were introduced in both the House and Senate. The House version, HB 2347, was assigned to both the Judiciary and Military Affairs and Public Safety (MAPS) committees. HB 2347 passed out of the MAPS Committee on February 3, 2010, by a 5-2 vote. Though it didn’t seem to be moving in the House Judiciary Committee, Chairman Adam Driggs assured us that he supported the bill, and was only waiting to see that the concerns of stakeholders had been addressed via negotiated amendments. On Tuesday, February 23rd, true to his word, Representative Driggs withdrew HB 2347 from the Judiciary Committee. It will now be scheduled for a review by the House Rules Committee before heading to a floor debate in the Committee of the Whole. Please take a minute to thank Chairman Driggs for his support: http://azcdl.capwiz.com/bio/id/158343 .

Amendments were made to the bills mainly to address law enforcement’s concerns, but the underlying restoration of the right to carry concealed without a permit remains unchanged. As a result, most rank and file law enforcement organizations have dropped their opposition to the Constitutional Carry bills. The highlights of the current version of these bills include:

- Eliminating the prohibition and penalties for law-abiding adults who carry a concealed weapon without a permit in Arizona except in places, like restaurants serving alcohol, where the law requires a CCW permit.

- Increasing the penalties for criminals who carry a concealed weapon in the commission or attempted commission of a serious, violent, or major felony crime.

- Requiring a person carrying a concealed weapon to notify a Law Enforcement Officer, upon their request, that the person possesses a concealed weapon.

- Adding more training options for obtaining a CCW permit.

- Eliminating the storage requirement for CCW permit holders who enter a “non-secure” public building.

- Allowing LEOSA certified retired Law Enforcement Officers to carry on school grounds.

- Requiring confiscated firearms to be sold to an appropriate retailer rather than destroyed.

In other news, also on February 23rd, Representative Driggs released HB 2543, the House version of the firearms preemption bill, from his committee. HB 2543 passed out of the House Military Affairs and Public Safety (MAPS) Committee on February 17th by a vote of 7-1 with a recommendation for passage by the full House.
